Application for Environmental Authorization Certificate
In Québec, many industrial activities or projects are subject to environmental regulations and may require authorization from the Québec Ministry of the Environment (MELCCFP). To determine whether your activity requires authorization, several factors must be considered, including the type of activity, its potential impacts on the environment and public health, and the applicable laws and regulations.
In Québec, the authorization certificate issued by the MELCCFP is a required document for carrying out certain activities that may impact the environment, in accordance with the Québec Loi sur la qualité de l’environnement (LQE).

RELEVANCE
Industrial Activities
Industrial facilities producing waste, atmospheric emissions, or handling hazardous substances may require an authorization certificate.
Work in Aquatic Environments
The construction of dams, interventions in rivers or water bodies, and projects affecting aquatic ecosystems may fall under these requirements.
Urban Developments
Construction, urbanization, or infrastructure projects—such as parks and green spaces, sports facilities, and transportation systems—must also comply with these regulations if they may have an environmental impact. Examples include sewer and water systems.
Construction on Former Waste Disposal Sites
Any development project on a former waste disposal site must be approved by the MELCCFP.

PROCESS
Activity Identification
The first step is to determine whether the proposed activity requires an authorization certificate. The LQE lists the activities subject to this requirement. It is essential to consult this list or contact the MELCCFP for specific guidance.
Application Preparation
Once you have confirmed that your activity falls under this requirement, you must gather all necessary documents. This may include plans, environmental impact studies, wetland inventories, Phase I environmental site assessments, Phase II environmental characterizations, technical analyses, and other relevant information. Several forms provided by the MELCCFP must then be completed to ensure they fully understand the nature of the project covered by the application.
Application Submission
The completed application is submitted to the MELCCFP via their online platform. It must be detailed and include all required information to allow for a proper assessment.
Evaluation
The MELCCFP carefully reviews the application, analyzes the submitted information, and evaluates the potential environmental impact of the activity. This process can take several weeks or even months. If necessary, the MELCCFP may request additional information or supplementary studies.

INTERPRETATION
OF RESULTS
Decision
Once the evaluation is complete, the MELCCFP decides on whether to grant or deny the authorization certificate. In the case of approval, specific conditions may be imposed to minimize environmental impact.
Monitoring and Compliance
If the authorization certificate is issued, it is essential to comply with the conditions specified. Periodic reports or monitoring may be required to ensure ongoing compliance.
